THE CITY OF BARNUM DOES ORDAIN:
SECTION 1 ANIMALS OTHER THAN DOMESTIC (HOUSE) PETS. No animals, other than domestic (house) pets shall be permitted in any zoning district other than the residential district zoned Open
No structures (excluding a doghouse and pen area) or uses of land intended for the care and grooming of animals other than domestic pets shall be permitted in any zoning district except the residential district zoned Open.
Domestic pets as used herein shall include those animals customarily kept for pleasure by the residents of a household, such as a dog or cat, but shall exclude animals of a size or quantity that require special housing outside of the principal use (e.g.: stable, cage, pit, pen) Animal activity at the Carlton County Fair grounds is excluded from the above definitions.
SECTION 2. RUNNING AT LARGE PROHIBITED. No dog shall be permitted to run at large within the limits of this City.
SECTION 3. DOGS ON A LEASH. The restriction imposed by Section 1 shall not prohibit the appearance of any dog upon the streets or public property when such dog is on a leash of ten feet (10') or less in length, and is under the control of the accompanying person.
SECTION 4. LICENSE REQUIRED. No person shall keep any dog over three months of age within the City without securing license from the Clerk, who shall keep a record of all licenses issued and shall issue a metal tag for each license. A prerequisite for purchase is proof of appropriate immunizations.
The annual license fee shall be set periodically by the City Council and will be posted at city hall. Licenses become effective January 1 and expire December 31 of each year. All parts of year preceding January 1 shall be deemed a year and the full license fee shall be paid.
SECTION 5 IMPOUNDING: The Animal Control Officer and/or other person as duly authorized in writing by the City Council shall impound any licensed dog found running at large and a reasonable attempt shall be made to give notice of the impounding to the owner of such dog. The owner of the dog has the right to redeem the dog, within seven (7) days of such notification, and upon paying the cost of impounding and appropriate immunizations.
In case the owner is unknown, and/or dog is unlicensed, such officer shall post notice at the City Office that if the dog is not claimed after seven (7) days of posting the notice, such dog will be placed up for adoption or painlessly disposed of.
The Animal Control Officer and/or such person as is duly authorized in writing by the City Council shall be Poundmaster. Impounding fees shall be set periodically by the City Council and will be posted at City Hall. A Poundmaster shall house and feed any dog held at the pound in a humane manner
SECTION 6. DOG NUISANCES: The owner or custodian of any dog shall prevent the dog from committing in the City any act which constitutes a nuisance. It is a nuisance for any dog to habitually or frequently bark or cry, to frequent school grounds and parks, to chase vehicles, to molest or annoy any person away from the property of his owner or custodian, or to damage, defile or destroy public or private property.
"Defile" includes depositing of animal feces. Animal feces deposited on property, other than the owners property must be removed immediately by owner or custodian and properly disposed of. Animal feces on owners property shall be removed and disposed of on a regular basis to prevent unsightly and unsanitary accumulations.
Failure of the owner or custodian of a dog to prevent the dog from committing such a nuisance is a violation of Ordinance 106, Section 8.
SECTION 7 QUARANTINE OF CERTAIN DOGS. Any dog which bites a person shall be quarantined for such time as may be directed by the Animal Control Officer. During quarantine, the animal shall be securely confined and kept from contact with any other animal. At the discretion of the Animal Control Officer, this may be on the premises of the owner; however, if the Animal Control Officer requires other confinement, the owner shall surrender the animal for the quarantine period to an animal shelter at the owner's expense or the owner shall, at his expense, place it in a veterinary hospital.
SECTION 8 PENALTY. Any person keeping a dog without a license or allowing a dog under his control to run at large, or violating any other provision under this ordinance, is guilty of a petty misdemeanor and upon conviction thereof shall be punished by a fine of not more than $200.00 and costs incurred by the City of Barnum for impounding and caring for the dog.
SECTION 9. REPEAL: Ordinance No. 88 and all other ordinances heretofore passed which are not in conformity with this Ordinance are hereby repealed.
SECTION 10 EFFECT: This Ordinance shall be in full force and effect after its passage and publication as required by law.
